Official Rules
Eligibility: The VETCBD Memorial Scholarship Award Program (the “Contest”) is only open to residents of the United States, age 21 and older as of the start date of the Contest. This Contest is sponsored by VETCBD 1968 South Coast Hwy Suite 3713 Laguna Beach, CA 92651 (“Sponsor”). Employees, officers, directors, agents, representatives of Sponsor, the legal, promotion and advertising agencies of any aforementioned entity, and their immediate family members (defined as spouse, mother, father, sisters, brothers, sons, daughters, uncles, aunts, nephews, nieces, grandparents and in-laws, regardless of where they live) and those living in their household (whether or not related), and each person or entity connected with the production or administration of the Contest, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity are not eligible. This Contest is subject to all applicable federal, state, and local laws. Void wherever restricted or prohibited by law.
Contest Period: The Contest Period begins on July 15, 2021, at 12:00 Pacific Time (“PT”), and ends on October 1, 2021, at 12:00 PT (the “Contest Period”). ALL NOMINATIONS MUST BE SUBMITTED DURING THE CONTEST PERIOD. By participating, Nominators and Nominees (as defined below) agree to be bound by these Official Rules and the decisions of the Judge (as defined below) and/or Sponsor, which are binding and final on matters relating to this Contest. All online entries must be received by December 1, 2021, at 12:00 PT.

Candidates for the VETCBD Scholarship Program (“Nominees”) must be nominated by someone other than the Nominee (the “Nominator”) in order to officially enter the Contest. Below, we describe the official process for Nomination.
Nomination Process
One submission per Nominee. A Nominator may submit multiple Nominations on behalf of different Nominees, and the same Nominee may be Nominated by different Nominators; however, multiple Nominations for the same Nominee by the same Nominator will not be accepted. Nominees may not submit Nominations on their own behalf, but may submit Nominations for other nominees.
Nominations must be received no later than October 1, 2021, at 12:00 PT according to Sponsor’s internal server time. No other methods of entry will be accepted. All Nominations received by the end of the Contest Period that are complete, meet the Nomination Guidelines in Sponsor’s sole discretion, meet with Sponsor’s general standards and practice, and are otherwise qualified will be eligible to win (“Qualified Nominations”). Sponsor reserves the right to disqualify any Nominator or Nominee it finds to be tampering with the entry process or the operation of the Contest or violating these Official Rules. Sponsor is not responsible for incomplete, late, lost, delayed, damaged, misdirected, incomplete, void, corrupted, garbled, illegible, or unintelligible Nominations and those Nominations are void and will not be accepted; nor is Sponsor responsible for any problems, bugs, or malfunctions Nominators may encounter when seeking to submit their Nominations. Proof of submitting any Nomination is not considered proof of delivery to or receipt of such Nomination.
Submission Guidelines:
Each Nominator shall be responsible for ensuring that it has all necessary permissions (including all permissions necessary to comply with these Official Rules) from each Nominee(s) prior to submitting a Nomination. Each Nomination must contain information that is true and accurate to the best of Nominator’s knowledge at the time the Nomination was submitted. All Nominations must be provided and created solely by the identified Nominator.
Respect: Any Nomination that is considered by Sponsor in its sole discretion to be offensive, obscene, libelous, inapposite to the reputation of Sponsor or any of Sponsor’s partners or affiliates, or to portray Sponsor in a negative light, or otherwise objectionable, unlawful, or inappropriate, or which otherwise does not comply with these Official Rules will be disqualified.
Permission: Upon submitting a Nomination, Nominator gives Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such Nomination in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology, now known or later developed, including for promotional or marketing purposes. Neither Nominators nor Nominees will be paid for their Nominations or for granting Sponsor any of these rights.
Judging: All Nominations shall be reviewed and judged by Sponsor’s Scientific Advisory Board Member, Dr. Katherine Kramer (“Judge”). Only Qualified Nominations shall be judged.
Judging Criteria: The Judge shall review and judge all Qualified Nominees based on the following criteria, each of which shall be given point values as indicated below:
Nominee’s history of and commitment to creating positive environments for teamwork [33 points]
Nominee’s history of and commitment to integrating and lifting up their peers [33 points]
Nominee’s history of and commitment to exhibiting compassion and empathy for their patients, clients, and peers [34 points]
In the event of a tie, a winner will be chosen at the discretion of the Judge.
Prizes: Six (6) Nominees (“Winners”) will each have $1,000 cash directly given to the tuition office at each Winner's educational program, as further outlined in a separate agreement between Sponsor and each Winner.
Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winners is permitted. Acceptance of prize constitutes permission to Sponsor to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
Approximate Retail Value (“ARV”) of each prize is $1,000. Total ARV: $6,000.
All Winners must have all necessary identification to claim prize. Winner is not entitled to any surplus between actual retail value of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. No substitution, transfer, or cash redemption of prize, or cash for any portion of prize not used, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. If the Winner does not want a portion of the prize, that portion is forfeited.
Winner selection and notification: The six (6) Qualified Nominations with the highest total points shall be deemed Potential Winners. Once the points are tallied and the highest point achievers are identified, Potential Winners will be notified by either phone or email using the email address provided in the entry form at the sole discretion of Sponsor or Sponsor’s representative on or about November 1, 2021. Potential Winners will be required to respond (as directed) to a phone and/or e-mail notification within five (5) business days of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize; and, in such case, Sponsor may choose the next highest scoring Qualified Nomination from among the remaining Qualified Nominations. Potential Winners will be required to sign and return a Declaration of Eligibility and Liability/Publicity Release (“Declaration”) and any other documents Sponsor or Sponsor’s representative may require within 48 hours of receipt of the Declaration. Failure to timely return a signed Declaration or other required documents or the return of any prize notification as undeliverable will result in Prize forfeiture. Federal and state income taxes may apply and are the sole responsibility of Potential Winners; Potential Winners may be issued an IRS Form 1099 for the ARV of any awarded prize. All expenses not specifically stated as being included are excluded, and are the responsibility of the Potential Winners.
Sponsor shall have no liability for a Potential Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Potential Winner’s provision of incorrect or otherwise non-functioning contact information. The receipt by Potential Winner of a prize is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER OR POTENTIAL WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER OR POTENTIAL WINNER’S DISQUALIFICATION AND ALL PRIVILEGES AS WINNER OR POTENTIAL WINNER WILL BE IMMEDIATELY TERMINATED.
Conditions: Contest is subject to these Official Rules. By participating, Nominators and Nominees agree: (i) to be bound by these complete Official Rules and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Contest or these Official Rules, except where prohibited by law. By accepting a prize, Winner agrees to release Sponsor, including its parent, subsidiary, and affiliated entities together with the respective directors, employees, officers, licensees, licensors, and agents, and respective advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Contest (collectively, the “Releasees”) from any and all liability, loss, or damage arising from or in connection with awarding, receipt, and/or use or misuse of prize or participation in any prize-related activities. Releasees shall not be liable for: (i) telephone system, telephone or computer hardware, software, or other technical or computer malfunctions, lost connections, disconnections, delays, or transmission errors; (ii) data corruption, theft, destruction, or unauthorized access to or alteration of entry or other materials; (iii) any injuries, losses, or damages of any kind, including death caused by the prize or resulting from acceptance, possession, or use of a prize, or from participation in the Contest; or (iv) any printing, typographical, administrative, or technological errors in any materials associated with the Contest. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest. Sponsor reserves the right to cancel or suspend the Contest, in its sole discretion, should it receive fewer than 6 entries, or receive no entries that have a judged score above 90 points, or due to circumstances beyond its control, including but not limited to natural disasters. Submissions will not be returned and may be destroyed.
Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Contest should a virus, bug, computer problem, unauthorized intervention, or other causes beyond Sponsor’s control, corrupt the administration, security, or proper play of the Contest. Sponsor may prohibit a Nominator or Nominee from participating in the Contest or winning prize if, in its sole discretion, it determines such Nominator or Nominee is attempting to undermine the legitimate operation of the Contest in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten, or harass any other players or Sponsor representatives. Use of automated entry devices or programs is prohibited. Any attempts to access the site, enter the Contest, or affect the Contest via a bot script, device, or brute-force attack will result in disqualification, including that IP address becoming ineligible for the entire Contest. Caution: any attempt to deliberately damage or undermine the legitimate operation of the Contest may be in violation of criminal and civil laws and will result in disqualification from participation in the Contest. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution.
Limitation of Liability: Nominator and Nominee agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries.
Publicity: Sponsor reserves the right to use the name, likeness, biographical information, and/or hometown name of any Nominator or Nominee for publicity purposes prior to, during, or after the Contest end date, in any media, and to use throughout the world, in perpetuity, without any compensation or prior review unless specifically prohibited by law. By participating, Nominators and Nominees agree that Sponsor, its agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors are not responsible or liable for, and shall be released and held harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with or resulting from participation in the Contest, or acceptance of the prize, including without limitation, claims based on publicity rights, defamation, or invasion of privacy. Should any Potential Winner be unwilling or otherwise unable to provide permissions and/or releases, or otherwise cannot accept or receive the prize for any reason, the Potential Winner with the next highest score will be chosen from the remaining Qualified Submissions until one who is able to meet all requirements can be selected.
Waiver of Jury Trial and Choice of Law. Except as prohibited by applicable law and as a condition of participating in this Contest, each Nominator and Nominee hereby irrevocably and perpetually waives any right s/he may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under, or in connection with this Contest, any document or agreement entered into in connection herewith, any prize available in connection herewith, and any of the transactions contemplated hereby or thereby. The internal laws of the State of California will govern disputes regarding these Official Rules and/or this Contest. All cases and claims pertaining to this Contest must be brought in a court of competent jurisdiction in the City of Los Angeles. As a condition of participating in this Contest, Nominator and Nominee agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will Nominator or Nominee be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than Nominator’s and Nominee’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest), and Nominator and Nominee further waive all rights to have damages multiplied or increased.
